MERRICK, N.Y. (AP) - Police on Long Island have arrested a man who allegedly shot a pellet rifle from his window at a construction worker across the street.

Nassau County police say Timothy Burzynski fired the gun around noon Tuesday from his Merrick home because he found the construction noise annoying.

Police recovered the pellet rifle and seven other firearms and ammunition from his house.

The 26-year-old Burzynski faces charges of criminal possession of a weapon at his arraignment Wednesday. It wasn’t immediately clear if he had a lawyer who could comment on the charges.

The 31-year-old victim was treated at a hospital for a wound to the upper back.
