WHEATFIELD, N.Y. (AP) - Authorities say a New York man was texting behind the wheel when he fatally struck a 16-year-old and then fled the scene.

The Niagara County Sheriff’s Office says 40-year-old Anthony DiFilippo has been indicted in the November death of Ryan Fischer in Wheatfield.

DiFilippo’s lawyer says he pleaded not guilty at his arraignment in Niagara County Court on Monday. DiFilippo, who lives near the crash site, is charged with felony leaving the scene of a fatal crash and tampering with evidence, along with failing to exercise due care and texting while driving.

Fischer was walking with his girlfriend on Nov. 20 when he was struck by a car that left the scene. He died a short time later.
