WEST PALM BEACH, Fla. (AP) - The Palm Beach County school board is challenging the state Board of Education’s authority in approving privately run charter schools.

The county board Monday asked the 4th District Court of Appeal to reverse a decision earlier this year by the state board to approve the South Palm Beach Charter School application.

The Palm Beach board had rejected the application, concluding the school did not plan to use any innovative or new education ideas as required by law. The charter school applicants called that an improper “rogue” decision.

The case could be closely watched across the state because it contends the charter school appeals process to the state board is unconstitutional, that the state board overstepped its authority and that its reversal wasn’t supported by evidence.
