BURLINGTON, Iowa (AP) - A judge has granted a delay until at least mid-January for the trial of a man accused of killing his 3-week-old son in southeast Iowa.

The Hawk Eye reports (https://bit.ly/1MDZoI8 ) that James Beres represents 22-year-old Randall Payne, and Beres asked Des Moines County District Judge Cynthia Danielson on Monday to postpone the Oct. 13 trial start. Beres said he needed more time to prepare a defense. Payne has pleaded not guilty to charges of first-degree murder and child endangerment.

Payne was arrested at his rural Burlington home in May. The body of Carter Joseph Payne was found by emergency crews after they responded to his father’s 911 call on Nov. 9 last year. Authorities say the mother of Carter Payne and his 1-year-old sibling were not home when Carter died.
