COLORADO SPRINGS, Colo. (AP) - A man who is accused hitting and killing a man while driving drunk and drag racing in Colorado Springs has waived his preliminary hearing in court.

The Gazette reports (https://bit.ly/1fWmbmu ) that 21-year-old John Marvel was supposed to appearing in court Wednesday. He has been charged with two felonies, two misdemeanors and two traffic offenses in the death of22-year-old Andrew Shada.

An arrest affidavit says on July 25 Marvel failed to negotiate a curve, ran off the road and struck Shada outside a home. Investigators say Marvel’s blood alcohol content was 0.133 percent at the time.

Marvel is scheduled to return to court Oct. 14 for a hearing.
