HINTON, W.Va. (AP) - A former Summers County commissioner’s embezzlement trial ended in a mistrial after the jury couldn’t reach a verdict.

Multiple media outlets report that Summers County Circuit Court Judge Robert A. Burns declared the mistrial on Wednesday. Burns scheduled an Oct. 16 hearing to discuss how to move the case forward.

Jerry E. Berry is charged with embezzling more than $10,000 from the county.

Prosecutors say the money was intended for the county’s convention and visitor bureau. Berry’s attorney, Rockwell Seay, says his client used the money to promote tourism in the county.
