LAKE WALES, Fla. (AP) - An 18-year-old college student has been charged with 42 counts of aggravated assault with a deadly weapon after authorities say he fired a BB gun at two school buses on a Florida highway.

Polk County Sheriff’s deputies arrested Phillip Gerard Smith II on Wednesday. He was also charged with three counts of shooting into an occupied vehicle. It’s unclear if he has retained an attorney to comment on the charges.

Authorities say he fired a BB gun at two school buses last Friday while traveling along Highway 17/92. Video surveillance helped capture the vehicle and authorities said they tracked it to the parking lot at Warner University where Smith is a student.

No one was injured in the alleged shooting, but Sheriff Grady Judd said Smith risked the lives of 39 children and three school board employees.
