PHOENIX (AP) - A taxi driver who was arrested in a man’s shooting death is out of jail.

KPNX-TV reports (https://bit.ly/1SiSAR5) the deadline to file charges passed and 28-year-old Joseph Wayne Petty was released.

County prosecutors have asked Phoenix Police for more information.

Petty told investigators he was getting gas when an altercation occurred between him and 25-year-old Michael Lopez, who said he had a weapon in his vehicle.

He said Lopez reached into the vehicle and he shot the younger man once.

Petty declined to speak on camera to KPNX-TV. He said in a telephone interview that he was looking forward to the opportunity to share his side of what happened.

No other gun was found at the scene.

Mariana Diaz is Lopez’s cousin. She says Petty reached out to the family.
