BATON ROUGE, La. (AP) - A 29-year-old Baton Rouge man charged in the 2013 beating death of his girlfriend’s infant daughter has received a new trial date of Jan. 30.

The Advocate reports (https://bit.ly/2biwOj6) Larry Leflore is charged with first-degree murder and second-degree cruelty to a juvenile. Prosecutors have chosen not to seek the death penalty because they didn’t want to force Aaliyah Heard’s brother, who allegedly witnessed his sister’s killing and was just 6 years old at the time, to testify.

Leflore, who is accused of hitting 11-month-old Aaliyah and throwing her after she refused to eat grits, would be sentenced to life in prison if convicted on the murder charge.

The new trial date was set Tuesday.

The infant’s mother, 31-year-old Ashley Heard, already is serving a life term in the case.
