NEW CITY, N.Y. (AP) - Authorities say a suburban New York driver is facing up to four years in prison for a fatal parkway crash.

Rockland County District Attorney Thomas Zugibe (ZOO’-gih-bee) says Phylip Derival of Spring Valley will be sentenced on Oct. 27.

He was convicted of criminally negligent homicide for the death of his passenger, 26-year-old Justin Goings of Haverstraw (HAV’-ur-straw).

Derival was driving about 92 mph on the Palisades Parkway in Orangetown in August 2013.

He tried to pass between two vehicles going in the same direction. He collided with one of them and forced the other off the road.

Then he hit a tree, killing his passenger.

Zugibe said a car in the wrong hands becomes “a weapon … like a gun or a knife.”
