CONWAY, S.C. (AP) - A South Carolina murder defendant is asking a judge to remove the prosecutors from his case.

Local media outlets report that attorneys for Javon Dion Gibbs want a judge to remove the 15th Circuit Solicitor’s Office from the Horry County case, arguing an assistant solicitor worked for Gibbs’ co-defendant as a public defender then later became a prosecutor.

Gibbs is charged in the August 2013 kidnapping and killing of 19-year-old Zachary Malinowski. The victim went missing and his burned car was found a week after he was last seen. Gibbs was charged 15 months later.

Prosecutors say that proper procedures have been followed and the assistant solicitor had minimal contact with the co-defendant’s case.

A judge will consider the issue at a later hearing.
