GREENVILLE, N.C. (AP) - A man sentenced to death for killing three convenience store workers will not receive a new trial.

News outlets report a judge ruled Thursday in a Pitt County courtroom that 33-year-old Antwan Andre Anthony will not be retried or resentenced because a sheriff’s office employee talked to a juror during the trial.

Anthony was sentenced to death April 5 after being convicted of first-degree murder in the 2012 deaths of three people working at a convenience store near Farmville.

His attorneys sought a new trial or a new sentence hearing, saying jurors overheard a Pitt County Sheriff’s Office public information officer comment on what should happen to Anthony.

The judge said that while the conversation did violate the no contact rule, it didn’t influence the jury in its deliberations.
