LAS CRUCES, N.M. (AP) - Las Cruces police say a driver who shot a passenger in another vehicle during a road-rage incident apparently fired in self-defense and won’t be charged.

Police say the 30-year-old man critically wounded in the Dec. 8 incident was with two other men and that they were aggressively pursuing the 28-year-old man who fired at the other vehicle.

According to police, witnesses confirmed the 28-year-old man’s account that the three other men began pursuing him after getting upset about an encounter at a traffic light.

Police say the 28-year-old man fled the scene but called police a short time later and acknowledged his involvement.

Police say they’re not releasing identities of those involved because there’s no expectation that charges will be filed.
