HENRICO, Va. (AP) - A Virginia man has been found not guilty of second-degree murder and child abuse in the January death of his 7-week old daughter.

The Richmond Times Dispatch reports (https://bit.ly/2ggNGZb ) that 22-year-old Diquan Burns was acquitted Thursday in a bench trial.

Burns testified that he accidently dropped the baby while trying to get her settle down.

Henrico Assistant Commonwealth’s Attorney Andrew Kolp argued that Burns handled the baby roughly to get her to stop crying. A doctor with the Children’s Hospital of Richmond at VCU said her injuries were “consistent with a non-accidental injury.”

Burns said he regretted not immediately telling others that he dropped her. The child’s mother tried to awaken the baby the next day, but she was unresponsive. The baby died at the hospital four days later.
