BALTIMORE (AP) - A Baltimore police officer who fatally shot a knife-wielding man at a child’s birthday party last year has been indicted on charges of assault and misconduct in office for using excessive force in a separate incident.

Officials say that Donald Gaff, a 3½ year veteran of the department, was indicted Wednesday for using unjustified force while making an arrest on Sept. 11.

Department spokesman T.J. Smith says no gun was used during the incident but that body camera footage showed Gaff using excessive force.

Gaff last year fatally shot a man who police said had been threatening to stab people and refused repeated commands to drop the knife he was holding.

Smith says Gaff has been stripped of his police powers.
