BREVARD, N.C. (AP) - A Transylvania County man will stand trial on charges he killed the man who was accused of killing his son.

The Times-News of Hendersonville reports ( ) the trial for 49-year-old Charles Richard O’Shields is scheduled to begin Tuesday. O’Shields is charged with first-degree murder in the shooting death of 27-year-old Toby Maxwell Mathis of Lake Toxaway on April 6, 2011.

Mathis had been charged with involuntary manslaughter in the death of O’Shields’ son during an altercation on Dec. 17, 2010. Twenty-year-old Joey Michael O’Shields fell to his death from the back of a pickup truck that Mathis was driving.

Affidavits state that Mathis was shot and killed in front of several people in a store.

O’Shields’ trial had been delayed several times over questions about his competency.
