BEAVERTON TOWNSHIP, Mich. (AP) - A van driver has been charged in a December crash with an Amish buggy in mid-Michigan that killed a woman and injured three children.

The Bay City Times reports (https://bit.ly/1SEnXu3 ) 58-year-old Kevin D. Toner of Coleman was arraigned Wednesday on one count of operating a motor vehicle under the influence causing death. Court records say he was under the influence of THC, the psychoactive chemical in marijuana.

His lawyer Ghazey Aleck tells The Associated Press that Toner is “sorrowful” about the Dec. 14 crash. Aleck says it was dark and rainy at the time and Toner couldn’t see the buggy, which didn’t have lights.

The Gladwin County sheriff’s department says 31-year-old Sarah Stutzman of Clare County died at the scene in Beaverton Township, about 125 miles northwest of Detroit.
