HOLLIDAYSBURG, Pa. (AP) - A judge has declined to bar prosecutors from using a defendant’s statements to police in his trial in a shooting death that stemmed from an argument at a party.

The (Altoona) Mirror (https://bit.ly/1oTkATJ ) reports that the Blair County judge also ruled that search warrants in the case were proper and there was enough evidence to try 35-year-old Jorge Luiis Gomez III of Altoona.

Gomez is charged with homicide, aggravated and simple assault and a firearms crime in the May 3 shooting death of 28-year-old Kai Carter.

Authorities allege that Gomez shot Carter outside a party in Altoona where people had gathered to watch the boxing match between Floyd Mayweather and Manny Pacquiao. Defense attorneys have argued that their client was “sucker-punched,” fell to the ground, and fired in self-defense.
