INDIANAPOLIS (AP) - A federal judge in Indianapolis has thrown out a $2.3 million lawsuit filed by a man charged in the killing of a police officer. Among the defendants named in the suit is the officer he allegedly killed.

Judge Tanya Walton Pratt’s ruling tossing Major Davis II’s suit does give him until Feb. 29 to refile an amended complaint. Pratt’s ruling was posted at the end of last week.

Davis is accused of killing Indianapolis Metropolitan Police Department Officer Perry Renn. He faces a possible death sentence if convicted.

Pratt’s ruling says, among other things, that Davis “failed to identify any viable defendant.”

Prosecutors say Davis killed Renn in 2014 as the officer responded to a report of shots fired. They say Davis was armed and traded fire with officers.
