NEWARK, N.J. (AP) - A motion to either increase or revoke the bail of a suspect accused of driving drunk and crashing into a minivan has been postponed.

NJ.com reports (https://bit.ly/1ShMPHf) that an attorney for Andre Higgs successfully requested in a Newark court to postpone arguments on the prosecution’s bail motion until Thursday.

Police say a motorist was hurt in the early Christmas morning crash in Cranbury.

New Jersey State Police say Higgs, already facing charges in the death of 27-year-old Latrena May, is charged with assault by auto and intoxicated driving. The Watchung man was released on $1 million bail following the May 1 killing.

Prosecutors said the couple was arguing outside May’s East Orange home. Higgs allegedly shot and killed May as a police officer approached. The officer then shot Higgs.
