DAYTON, Ohio (AP) - A southwest Ohio man accused of firing at a vehicle and striking a 2-year-old boy in the head has been indicted on four counts of felonious assault.

The Montgomery County prosecutor said Thursday that 20-year-old Nickolai (NIHK’-oh-leye) Gray Jr., of Dayton, also faces two weapons-related charges. He’s being held on $500,000 bond.

Defense attorney L. Patrick Mulligan says he anticipates Gray will plead not guilty at arraignment, scheduled Tuesday. Mulligan says he’s investigating the case. He declined to comment further.

Dayton Children’s Hospital said earlier this week that the child, Christian Green, was in serious condition. He’d been hospitalized initially in critical condition.

Police say shots were fired at a car that subsequently struck a tree Dec. 24 in Dayton. Police say the suspect had a dispute with a passenger.
