BENNINGTON, Vt. (AP) - The Southwestern Vermont Medical Center has reached a $275,000 settlement on a wrongful death claim on a man who fell after getting out of a hospital bed.

The 2013 complaint says Donald Prouty went to the hospital in August 2011 complaining of pain caused by recent falls. He had other health issues. The hospital determined that he was at a high risk of falling. The claim says 56-year-old Prouty got out of bed, fell and was injured on Aug. 25. He later died.

Prouty’s wife, Jean Prouty, filed the claim against the center in 2013, alleging the hospital didn’t follow its own safety protocols to prevent patients from getting out of bed and falling.

The Bennington Banner reports (bit.ly/1Z87BYY) the motion to allocate wrongful death settlement proceeds was filed Tuesday.

The hospital’s attorney didn’t immediately return calls.
