TUCSON, Ariz. (AP) - A former Border Patrol agent has been sentenced in federal court in Tucson to just under six years in prison for possession of child pornography.
A judge on Wednesday sentenced 39-year-old Nicholas Peter Berner to 71 months in prison after Berner pleaded guilty to one count of possession of child pornography.
The U.S. Attorney’s Office for Arizona says Berner was a Border Patrol agent before he was indicted in the criminal case in 2014.
Berner acknowledges in a plea agreement with prosecutors that his computer had over 2,500 files of child pornography, including many depicting children under age 12 being sexually abused.
He also acknowledged making the images available for downloading by other users of a file-sharing network.
