NEW ORLEANS (AP) - A state inmate mistakenly released from the New Orleans’ jail is back in custody.

The Orleans Parish Sheriff’s Office, in a news release Monday, said 27-year-old Ervin New was serving time on state charges of simple burglary and home invasion. New was awaiting a hearing on an additional charge of aggravated battery and he accepted a plea deal in which he was sentenced to six months but given credit for time served. A clerical error resulted in his release June 28.

Officials say the error was discovered last week during a supervisory review and remains under investigation.

Authorities located New in the Dallas area. He voluntarily returned Friday to New Orleans. Because his state charges are still in effect, New will be transported back to a state correctional facility soon.
