MADISON, Wis. (AP) - A prosecutor says he won’t charge a Wisconsin sheriff’s deputy who killed a man during a drug investigation.

Walworth County Sheriff’s Deputy Juan Ortiz opened fire on a vehicle he believed was trying to run him over during a drug investigation in an East Troy restaurant parking lot in February. Twenty-one-year-old Christopher Davis, one of the passengers in the vehicle, was shot in the head and died.

The car took off but Ortiz gave chase and used his own vehicle to ram the car into a mailbox. Two other suspects in the vehicle ran but police caught and arrested them.

Walworth County District Attorney Dan Necci released a statement Tuesday saying the shooting was justified because Ortiz believed he was in danger. The prosecutor said he wouldn’t be able to convince a jury otherwise.
