JACKSON, Miss. (AP) - Mississippi’s state appeals court has refused to revive a lawsuit filed against the town of Terry by its former police chief.

Juan Gray had filed suit alleging he was wrongfully discharged. A Hinds County court dismissed the suit last year. The appeals court upheld that decision in an order dated Wednesday.

The decision includes a summary of the case that says Gray was told in September 2012 that he would be fired if he didn’t resign and accept a $5,500 severance package. Gray signed the agreement.

The appeals court said Gray effectively waived a wrongful discharge claim when he signed the agreement. The court also rejected arguments that Gray was a victim of defamation and invasion of privacy because the mayor publicly disclosed information about his resignation.
