FRESNO, Calif. (AP) - The family of a Fresno man who was killed by police in September has filed a federal civil rights lawsuit in connection to the shooting.

The Fresno Bee reports (https://bit.ly/29XS6QK ) that an attorney for 45-year-old Casimero “Shane” Casillas filed the lawsuit Tuesday accusing the Fresno Police Department of wrongful death, excessive force and negligence.

A sheriff’s spokesman says a Fresno police officer shot Casillas because the man had a metal pipe. An investigation by the Fresno County Sheriff’s Office under the direction of the District Attorney’s Office determined the use of deadly force was justified.

Attorney Bill Schmidt says police rushed to apprehend Casillas because his passenger was not wearing a seatbelt and then followed him home and shot him.
