LAS VEGAS (AP) - A federal court in Las Vegas is being asked to take up a civil lawsuit filed by an autistic teenage girl’s family against the Clark County School District and a teacher’s assistant jailed on child lewdness charges.

Court records show that 59-year-old Fausto Barraza-Balcazar is due for a preliminary hearing Aug. 8 in Las Vegas Justice Court on four felony charges stemming from an investigation at Mack Middle School.

Barraza-Balcazar was arrested June 11 after a school employee reported seeing him in a washroom with a 13-year-old special education student.

The Las Vegas Review-Journal reports (https://bit.ly/2a3O7Wk ) the school district filed to move the separate civil negligence lawsuit to U.S. District Court under federal Title IX anti-discrimination law.

A school district spokeswoman said the district doesn’t comment on litigation.
