MIDDLETOWN, Pa. (AP) - A split vote by a Pennsylvania zoning hearing board means a funeral home’s plans for a crematory can move forward.

The Middletown Zoning Hearing Board denied an appeal by opponents of the proposed facility in a 1-1 procedural vote, upholding the original permit approval to Fager-Finkenbinder Funeral Home.

The Middletown Citizens Awareness Network had argued that a former borough manager fast-tracked permits for the crematory without giving proper notice. A spokesman for the group says they’re disappointed and will appeal the decision.

The funeral home’s owner says construction of the crematory is still contingent on obtaining building and environmental permits.
