CONWAY, S.C. (AP) - A man whose kidnapping case ended in a mistrial has been sentenced to five months in jail for talking to the media about his case.

Media outlets report that Circuit Judge R. Markley Dennis accepted an apology from Sidney Moorer in court Friday, but still ruled he was in contempt of court for violating his gag order.

Moorer spoke to a reporter after the second day of his kidnapping trial in the December 2013 disappearance of then 19-year-old Heather Elvis, who has not been seen since.

The jury deadlocked, and prosecutors plan to try Moorer again.

Moorer was taken to jail immediately to begin serving his sentence.
