LAS CRUCES, N.M. (AP) - Authorities say a Las Cruces man has been indicted in the beating of a 12-year-old boy.

The Third Judicial District Attorney’s Office says 34-year-old Dustin Wagner is charged with one count of child abuse, a third-degree felony.

If convicted as charged, prosecutors say Wagner faces up to 3 years in prison.



It was unclear Friday if Wagner has a lawyer for his case.

The incident alleged occurred July 4 in Las Cruces.

According to investigators, the boy suffered bruising on his face, back, neck, chest and arms.

Wagner was arrested and posted bond after a judge reduced the bond from $40,000 cash to $10,000 secured.

Prosecutors argued to keep the bond at $40,000 while citing concerns for other children in the home and the defendant’s ties to other jurisdictions.
