MINOT, N.D. (AP) - Trial has been delayed for Ward County Sheriff Steve Kukowski, who faces misdemeanor charges in the death of an inmate.

Kukowski was to stand trial beginning Aug. 29 on charges of refusing to perform a public duty and reckless endangerment in the October 2014 death of 25-year-old jail inmate Dustin Irwin.

Prosecutor Seymour Jordan on Thursday requested a delay, and Judge Lolita Romanick granted a continuance until Oct. 3.

Romanick also denied a request by defense attorney Peter Welte (WEHL’-tee) to dismiss the charges against Kukowski.

Kukowski is on paid suspension. He is awaiting a decision by a special commissioner on whether his due process rights were violated when Gov. Jack Dalrymple suspended him.

Kukowski maintains his innocence.
