KINGSTON, N.Y. (AP) - A Hudson Valley dentist has been acquitted of fatally poisoning his lover’s husband five years ago.

An Ulster County Court jury found 49-year-old Gilberto Nunez not guilty of second-degree murder Tuesday afternoon. Nunez was found guilty of forgery for falsely claiming he was a member of the CIA.

Prosecutors say Nunez killed Thomas Kolman of Saugerties (SAW’-ger-teez) by giving him coffee laced with a dental sedative. The defense said Nunez had nothing to do with Kolman’s death, and said Kolman’s heart condition and sleep apnea were possible factors.

The 44-year-old Kolman’s body was found inside his vehicle in a gym’s parking lot outside Kingston in November 2011. Prosecutors say Nunez was having an affair with Kolman’s wife and wanted the husband out of the way.
