LANCASTER, Calif. (AP) - A state appeals court has upheld a Los Angeles County man’s conviction for killing his girlfriend with a sword in front of her four children.

The City News Service reports that a three-justice panel on Wednesday rejected the defense’s argument that there wasn’t enough evidence to support Jesus Humberto Canales’ murder conviction for the July 2008 stabbing death of 26-year-old Lucy Preciado.

Preciado’s children were between 7 months and 9 years old at the time. She had three of the children with Canales.

The appeals court decision says the evidence points to a calculated, deliberate attempt to kill Preciado. It notes that Canales testified he was under the influence of methamphetamine and didn’t know what he was doing, but said the jury didn’t have to believe that.

Canales is serving a 36-year-to-life sentence in state prison.
