NEW ORLEANS (AP) - A federal judge has ruled she won’t dismiss New Orleans Saints and Pelicans owner Tom Benson’s lawsuit against a trustee who has blocked Benson’s bid to repossess shares of his NFL and NBA teams from estranged heirs.

In an order published Friday, U.S. District Judge Jane Triche Milazzo confirms that a non-jury trial will begin June 20.

Trustee Robert Rosenthal has blocked Benson’s effort to remove non-voting shares of the teams from the estranged heirs’ trusts in exchange for more than $500 million in other assets, comprised mostly of promissory notes. Rosenthal contends it’s not an equal swap.

Friday’s ruling wasn’t a total victory for the 88-year-old Benson, who had asked the judge to close parts of trial. Milazzo has ruled the trial will remain open to the public.
