CULPEPER, Va. (AP) - Virginia State Police are identifying a Culpeper man they say was fatally shot when his neighbor fled to his home during an argument with her estranged husband, who was later killed by a deputy sheriff.

Police identified the man in a statement Wednesday night as 74-year-old James Stewart.

Police say the woman ran to Stewart’s home for refuge Tuesday during an argument with 49-year-old Willis Walker Jr. They say Walker forced his way inside the house, where he shot Stewart, then assaulted the woman.

Another woman hidden in the house called 911. State police say Walker threatened Culpeper County deputies with a shotgun and was fatally shot after refusing to drop the gun and advancing toward them.

Police say Walker was black, and the deputy who shot him was white.
