SIOUX FALLS, S.D. (AP) - A 23-year-old man has been indicted on rape and burglary charges after police in Sioux Falls used his cigarette pack to track him down.

The Argus Leader (https://argusne.ws/1LhgDCe ) reports an indictment charges Sioux Falls resident Mario Banegas-Jaen with second-degree rape and first-degree burglary.

A woman told police a man entered her apartment on Feb. 10 and raped her. Court records show the man, later identified as Banegas-Jaen, left a pack of cigarettes in the victim’s bedroom, and police used a convenience store’s surveillance video to see who had bought the same cigarette brand around the time of the incident.

The newspaper reports Banegas-Jaen told police he “had sex” with the victim, whom he didn’t know, and wanted to apologize.

Banegas-Jaen is at the Minnehaha County Jail. It wasn’t immediately clear if he has an attorney who could comment on his case.
