DUBUQUE, Iowa (AP) - The Iowa Court of Appeals has dismissed the appeal of a man convicted in the sexual assault of a woman at his Dubuque apartment.

The Telegraph Herald (https://bit.ly/1pL72u0 ) reports that 38-year-old Scott R. Robinson’s appeal seeking to vacate his lifetime supervision was dismissed Wednesday. Robinson was convicted of third-degree sexual abuse in March 2015 and was sentenced to 10 years in prison and lifetime supervision by the Iowa Department of Corrections.

Robinson had argued that his lifetime supervision sentence is unconstitutional because it is cruel and unusual punishment.

He had previously been convicted of first-degree kidnapping in the sexual assault of a woman at his residence in 2011 and was sentenced to life in prison without parole. But the Iowa Supreme Court unanimously rejected that conviction in February 2015, saying his actions did not equate first-degree kidnapping.
