DAYTON, Ohio (AP) - Federal court records show a former county corrections officer in Ohio has been indicted on a charge of engaging in a sex act with a person incapable of appraising the nature of the conduct.

The Dayton Daily News (https://bit.ly/1RqAOwU ) reports 31-year-old Kyle Jordan was charged in an indictment filed in U.S. District Court in Dayton. The indictment alleges Jordan violated federal law in December 2015 at Wright-Patterson Air Force Base. He was arrested March 19. Court records don’t list an attorney for the former Butler County corrections officer who resigned in 2015.

The indictment unsealed Thursday says the female that Jordan is accused of engaging in sex with was physically incapable of declining or participating in the sexual act or communicating unwillingness to engage in that act
