SPLENDORA, Texas (AP) - Investigators say a Houston-area sheriff’s deputy has fatally shot an armed man who refused to drop the gun and pointed the weapon at officers.

The Montgomery County Sheriff’s Office says a deputy opened fire Sunday afternoon, killing 33-year-old Earl Ashby.

Lt. Brady Fitzgerald says deputies were dispatched to a home in Splendora on a report of a man threatening to kill himself. Officers safely removed three people from the residence, then located Ashby in a shed.

Fitzgerald says the shed door opened, Ashby came out and deputies ordered him to drop the gun. Fitzgerald says Ashby refused, moved toward the deputies and pointed the gun at officers.

One deputy then shot Ashby, who died at a hospital.

The deputy’s name wasn’t immediately released.

Splendora is 25 miles northeast of Houston.
