WORCESTER, Mass. (AP) - The lawyer for a Massachusetts spine doctor accused of sexually assaulting two women patients is asking for a rape charge against him to be dismissed.

Dr. Ho Yin “Aaron” Shiu, formerly of Shrewsbury, was indicted in 2014 on multiple counts of indecent assault and battery and one count of rape. He pleaded not guilty to the charges.

A 42-year-old patient Shiu met in 2013 at UMass Memorial Medical Center alleges that Shiu had her remove her underwear and inappropriately touched her without wearing gloves.

The Telegram & Gazette reports (https://bit.ly/1ROuzD1 ) Shiu’s lawyer filed a motion last month asking that the rape charge be thrown out due to insufficient evidence.

He says the jury heard no evidence of Shiu allegedly using force, which he says is an element of rape.
