SAN JOSE, Calif. (AP) - A district attorney in Northern California says he wants three former San Jose State University students to go to jail for forcing a bike lock around a black roommate’s neck.

KTVU-TV reports (https://bit.ly/1LOB4GE ) that the young men were each found guilty of misdemeanor battery but not convicted of hate crimes. The jury deadlocked on that charge for two of the men and found the third not guilty.

Santa Clara County District Attorney Jeff Rosen says he won’t retry them on the hate crime charges. But he says he is asking Superior Court Judge Thang Barrett to sentence each man to four months in jail and 50 hours of community service.

The black freshman has sued the university. The white students were expelled.
