SIOUX FALLS, S.D. (AP) - City officials are questioning whether a downtown bar is using its patio to get around the state’s indoor smoking ban.

The Argus Leader reports (https://argusne.ws/25i9gAe ) that the issue is whether Wiley’s Tavern’s smoking patio on the northeast corner of its building meets South Dakota’s indoor smoking regulations. Since the addition was completed in July 2014, patio patrons have been permitted to light up, even when the garage doors are down during winter months.

Assistant City Attorney Keith Allenstein says that if it’s not an enclosed area, patrons can smoke and drink and play video lottery outside. But he says it seems it could very well be considered an enclosed area.

Part-owner Bryant Soberg says the patio is compliant with state smoking and video lottery law.
