FARGO, N.D. (AP) - A Fargo man says he will plead guilty to failing to pay income taxes for a period of more than a decade.

Gary Spencer Smith is charged in federal court with income tax evasion. The charge carries a maximum penalty of five years in prison and a $250,000 fine.

Authorities say Smith failed to pay more than $243,000 he owed to the government between 1999 and 2010.

Smith’s attorney, Lorelle Moeckel, declined to comment.
