ODESSA, Texas (AP) - A West Texas man must serve 10 years of probation for the 2014 fatal shooting of his girlfriend as he examined a gun while at his parents’ home.

Eric Holguin of Odessa was convicted Thursday of manslaughter. Holguin was acquitted of aggravated assault with a deadly weapon in the death of 23-year-old Kimberly Root.

The defense said the March 2014 fatal shooting was an accident. Prosecutors say Holguin, who testified that he did not own a gun, was negligent in his handling of two weapons.

The 26-year-old Holguin said he pulled the trigger of one handgun and nothing happened. He testified he did the same with a second pistol - which fired, striking Root.

Holguin said he assumed the second weapon wasn’t loaded because the first one was not.
