SPOKANE, Wash. (AP) - The family of a man who was shot and killed by police outside a Spokane Salvation Army has filed a lawsuit against the city and the former police chief.

The Spokesman-Review reports (https://bit.ly/2bELJHB ) that Danny Jones’ wife and children have filed a wrongful death claim just before the three-year statute of limitations expired.

Jones was killed Aug. 22, 2013 after leading police officers on chase. Autopsy reports found Jones had drugs in his system at the time of the shooting and witnesses said he was acting wildly and saying he wouldn’t be taken alive.

The Spokane County Prosecutor’s Office declined to prosecute the officers involved.

Police spokeswoman Teresa Fuller declined to comment on the case, saying the department would not speak about pending litigation.

City officials also declined to comment.
