CONWAY, S.C. (AP) - A state judge has dismissed local prosecutors from trying a murder case in Horry County.

Local news outlets report that Circuit Judge Larry Hyman agreed Wednesday to a defense request to remove the local prosecutor’s office from trying the case of two men charged in the 2013 kidnapping and slaying of 19-year-old Zachary Malinowski.

Defense attorneys argued that an assistant solicitor had worked as a public defender for one of the men charged, 22-year-old Christopher Brown, before beginning work for the prosecutor’s office.

Hyman said he was removing the local solicitor’s office from the case out of an abundance of caution to avoid the appearance of impropriety.
