RICHMOND, Va. (AP) - A Virginia man who told police he wasn’t sure if a gun was loaded when he pressed it against an officer’s stomach and pulled the trigger has been sentenced to 10 years in prison.

As it turned out, 25-year-old Donte J. Watts’ revolver was empty of charges and Richmond officer Jared Crain was not injured in their March 7 struggle.

The Richmond Times-Dispatch reports that Watts pleaded guilty Thursday to attempted capital murder of a police officer, use of a firearm in a felony and shooting into an occupied dwelling.

Prosecutor Michael Hollomon said authorities believe Watts and a companion had intended to rob someone or break into an apartment.

Defense attorney Christopher Bradshaw said Watts had a documented history of mental health issues and no prior criminal record.
