PHOENIX (AP) - A judge has overturned a Pinal County half-cent sales tax for transportation projects, ruling that the scope of the measure approved by voters in 2017 didn’t comply with state law.

State Tax Court Judge Christopher Whitten’s ruled Thursday against the county and in favor of the Goldwater Institute, a Phoenix-based advocacy group that sued on behalf of taxpayers challenging Proposition 417.

The tax began to be implemented on April 1 and the Goldwater Institute said Thursday that the ruling means that the resulting revenue that was put in an escrow account pending the lawsuit’s outcome now must be refunded.

County officials envisioned the money being used for projects such as a new freeway to connect Apache Junction with Interstate and widening of State Route 347.
