SCHENECTADY, N.Y. (AP) - Two former Pizza Hut delivery drivers are suing the company, claiming its delivery fees on orders illegally cut into their tips.
The Daily Gazette of Schenectady reports (https://bit.ly/1PuhInc ) the lawsuit filed in Albany federal court says the pizza chain violates New York labor laws by keeping delivery fees as a profit.
The suit alleges that Pizza Hut’s mandatory delivery fees give customers the impression they are part of the tip, but drivers receive no portion of it.
William Lewis worked as a delivery driver for a Pizza Hut in Schenectady (skeh-NEHK’-ta-dee) from 2005 to 2012.
Attorneys for Lewis and Syracuse resident Samantha Crawford are seeking a class-action lawsuit that would consider all the company’s delivery drivers.
A message left Monday at the company’s Plano, Texas, headquarters seeking comment wasn’t returned.
